Disciplinary complaints about magistrates

If you believe that a member of the judiciary has acted in a manner contrary to the principles of professional ethics in legal proceedings concerning you and in the performance of his or her duties, and that this conduct is liable to be classified as disciplinary, you may refer the matter to the National Council for the Judiciary (Conseil national de la justice).

To be admissible, the complaint must contain

  • the identity, address and signature of the author
  • a summary of the alleged facts and grievances
  • information that help identify the procedure in question

and

  • not be directed against a member of the Public Prosecutor's Office when the Public Prosecutor's Office to which he belongs continues to be responsible for the proceedings
  • not be directed against a judge who remains in charge of the proceedings
  • not be lodged more than one year after an irrevocable decision has been taken terminating the proceedings

A complaint is not a new legal remedy. It does not allow you to challenge the court decisions themselves.
